TERM OF LEASE (Rental Period)

The Stager’s Warehouse Inc. Team requires up to 48 hours to prepare your order for pick up or delivery. It is important to note that the term of this Lease shall commence on date of pick-up or delivery or 7 days after order is placed, whichever comes first. This term of lease shall continue on a month to month basis until terminated in accordance with this agreement. You (the “Lessee”) hereby request The Stager’s Warehouse Inc. (the “Lessor”) to prepare for delivery or pick up the furniture on the attached quotation/contract. Lessee understands that the minimum rental period is 1 (one) month. Lessee will not be entitled to a refund of any portion of rent for the month. Lessee shall pay the Lessor as a monthly rent, without deduction, prior notice, demand or billing statement, the monthly rent plus all applicable taxes.


Lessee agrees to pay Lessor lease payments, payable in monthly installments in Canadian currency to start once a month in accordance with the Term of Lease. If the Lessee does not confirm (in writing) to either renew or cancel their lease prior to Five (5) days of the lease ending, the Lessor will automatically charge a second month to the credit card on file.


This lease may be terminated by either party upon notice as set forth in this section: a) Lessee may terminate this lease at any time by giving a Minimum Seven (7) days “Written Notice” to Lessor or booking pick-up through The Stager’s Warehouse Inc. website Pick Up Form.  If lease is terminated after delivery and prior to the full month rental period, no money will be refunded to lessee.


Lessee shall be responsible for any and all collection, collection agency, legal and court costs incurred in the collection of past due accounts. Lessor reserves the right to report any delinquencies of Lessee to any credit reporting agencies or other parties including but not limited to other Lessors and consumer credit agencies.


If Lessee fails to make any payments of any amounts payable herein as and when such payment becomes due and/or if Lessee defaults in the performance of any other obligations hereunder, and such non-payment or other default continues for a period of 10 consecutive days, Lessor may, at its option, do any of the following: 1) Declare, by written notice to Lessee, the entire unpaid rent and all other amounts payable, and the payment of such amount shall be so accelerated and such amount shall be payable by Lessee promptly. 2)Terminate this lease upon written notice to Lessee. 3) Proceed by appropriate court action or actions at law or in equity or in bankruptcy to enforce performance by Lessee of the covenants and terms of this Lease and/or to recover damages for the breach of them. 4) Whether or not this lease be so terminated, and without notice to Lessee, Lessor repossess the furniture wherever found, with or without legal process, and for this purpose Lessor and/or its agent may enter upon any premises of or under the control or jurisdiction of Lessee or any agent of Lessee without liability for suit, action or other proceeding by Lessee (any damages occasioned by such repossession being expressly waived by Lessee) and remove the leased furniture. Lessee hereby consenting to such repossession and waiving any right to notice or a hearing of any kind prior to such repossession. Pursuit of any of these actions shall not be deemed to be exclusive, but shall be cumulative and shall be in addition to all other remedies.


Lessor can arrange delivery of the leased furniture through a third party delivery company. The Lessor shall not be held responsible for any damages made by any third party delivery company.  Lessee will make arrangements for access to the premises. If the Lessor is unable to access the premise in order to deliver the leased furniture, there will be a charge of $20 for every 15 minutes (to a max of 45 minutes) until Lessor has access. On delivery, Lessee shall immediately inspect each item of furniture delivered. Unless Lessee notifies Lessor in writing within 24 hours from the time of actual delivery, specifying any defect or objection to the furniture, Lessee will be conclusively presumed to have fully inspected and acknowledged that the furniture is in good condition, and that Lessee is satisfied with and has accepted the furniture in good condition. If rental items are immediately returned by lessee during the delivery, a restocking fee of 15% will be charged to the credit card on file if items exceed over $99. Lessee must notify us of any parking restrictions or special instructions prior to delivery. Failure to notify us may result in additional parking ticket charges if a parking ticket is received during furniture delivery time and this will be charged to credit card on file. Lessor will not be responsible or held liable for any damages occurred from moving of existing chattels or fixtures requested by lessee.


If Lessee opts to self pick-up and drop-off leased items, please ensure that you allot for the extra time that will be required to receive back this inventory on Drop-off day as The Stager’s Warehouse Inc. team twill be inspecting condition of the returning inventory.


The leased property shall not be removed from the address to which it is delivered without the lessor’s written consent. If Lessee transfers the leased items to a different address without approval, a transfer fee will be charged to the Lessee. A MINIMUM fee of $500 will apply and the fee will be determined by the Lessor. Lessee is responsible for covering any cleaning, repair or replacement costs resulted from breakage, loss, unreasonable or excessive wear or any other damages incurred by Lessee. Replacement cost of each item is 10 times the monthly rental rate. • Lessee must notify Lessor about any pets present at the property during furniture rental term. To prevent possible infestation or an allergic reaction in future clients, $75 cleaning cost per upholstered item will apply to properties that have non-hypoallergenic pets. • No smoking is permitted at the property during the furniture rental term. If rental property from the Lessee is returned to the Lessor with smoke smells, the Lessee is responsible to cover all cleaning costs to remove the smell or replacement cost will apply. If rented property needs to be replaced because the smell cannot be removed, replacement cost of each item is 10 times the monthly rental rate.


On the termination of the Lease for any reason whatsoever, Lessee shall return the leased furniture to Lessor in as good condition as when received. Lessee agrees to have furniture ready for pick up on the assigned date. Failure to do so will incur additional pick up charges. If Lessee fails to return the leased property as required, Lessee will be liable to Lessor for an amount equal to full replacement cost of the leased property in addition to all other payments and charges due under the is lease agreement.


Lessee hereby authorizes Lessor to collect, use and release any personal information regarding Lessee in accordance with the applicable law and that allows Lessor to effectively service Lessee’s account
